1. About GOODMA

GOODMA is in to purchase, lease or otherwise acquire, establish, maintain, operate, run, manage or administer hospitals, medicate, daycare and healthcare centers, nursing homes, clinics for in-door and out-door patients and facilities for reception and treatment of persons suffering from injuries and illness, disabilities and deficiencies of any kind or nature whatsoever and treatment of persons requiring medical attention, geriatric care centre, in the specialty departments. And to provide medical relief to the public in all branches of medical sciences by all available means and to manage, administer, own and to carry on the business of running hospitals, clinics, dispensaries, maternity, homes, child welfare and family planning centres, diagnostic centres, running crèches, design, manufacture, import, export, buy, sell or lease out, install, maintain and deal in any kind of equipment, instruments, medicines and drugs for hospital, dispensaries, clinics, laboratories and health clubs and to own, manage, administer or run all type of laboratories for carrying on investigations and to run X-ray, E.C.G. CT scan etc

2. Customer Agreement

You on behalf of Patient request GOODMA to provide Service at home or any other location agreed with GOODMA. You agree that the Service is advised by a legal medical practitioner and you undertake the responsibility of Service and risks involved. GOODMA will ensure high quality of Service but will not be responsible for any Service error including criminal activity by Service Givers. You understand and agree that the Service offered by GOODMA directly or through Service Givers/affiliates of GOODMA has a risk of failure and/or adverse effects resulting in possible mortality or permanent disability. You understand and agree that GOODMA does not guarantee any recovery or outcome from the Service offered. You agree to provide safe environment for Service Givers to discharge their duty and you will ensure that they are not harassed, abused or troubled in any way physically or emotionally. You authorise GOODMA to collect Patient’s data and use/share the same with others (without revealing Patient’s identity). GOODMA will not be responsible for misuse of Patient’s data by Service Givers, affiliates, employees or other party. You will make payments to GOODMA as per the terms agreed and will not link it with outcome of the Service.

3. Scheduling Appointments

Appointments for Service with GOODMA can be scheduled through the Service Givers website or mobile app or by calling___________________. Your request for Service is only accepted when you receive a booking confirmation from GOODMA.

4. Service Giver Selection

GOODMA has a pool of Service Givers to choose from to provide the Service. GOODMA will ensure that the Service Giver assigned is as per your preference but this may not be possible all the time. GOODMA reserves the right to assign any Service Givers as it deems fit for that Service. GOODMA does not guarantee that same Service Givers is assigned on all days. GOODMA can assign any Service Givers on any day as it deems fit without prior notice.

5. General Payment Terms

The payment can only be made via cash, payment gateway or Cheque drawn in favor of _______________________________You agree to make payment as soon as the demand is raised. GOODMA reserves the right to cancel an ongoing or future appointment if payments are not made on time.

6. Intellectual Property Rights

All the intellectual property used on the Websites by GOODMA, service providers or any third party shall remain the property of GOODMA, service provider or any other third party as the case may be. You agree not to circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any materials or enforce limitations on use of the Website or the materials therein. The Service is protected to the maximum extent permitted by copyright laws, other laws, and international treaties. Content displayed on or through the Services is protected by copyright as a collective work and/or compilation, pursuant to copyrights laws. The materials on the Websites or otherwise may not be modified, copied, reproduced, distributed, republished, downloaded, displayed, sold, compiled, posted or transmitted in any form or by any means, including but not limited to, electronic, mechanical, photocopying, recording or other means.

7. Limitation of Liability

In no event shall GOODMA be liable for any special, incidental, indirect or consequential damages of any kind in connection with these terms of use, even if user has been informed in advance of the possibility of such damages. In no event shall the total aggregate liability of GOODMA to a user or professional for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from this agreement or a user’s use of the website or the services exceed, in the aggregate INR 100/- (rupees One Hundred Only).

8. Information You Provide GOODMA

When you request a Service from GOODMA, you agree to provide personal information about yourself and the Patient such as name, mobile number, date of birth, gender, weight and medical information about the Patient relevant to the Service. You agree to provide accurate personal and medical information about the Patient and your failure to do so may result in adverse consequences in delivery of Service. GOODMA may provide this information to assigned Service Givers as it deems fit.

9. Customised service and payment flow

Every patient is different. At GOODMA, upon receiving your request, we have a detailed conversation with you about your specific medical condition, and then suggest the best course of action. We ask for a payment only when you agree with our proposed plan of action as well as the costs involved. We can request online payments through SMS, email, website, or our mobile app, which also simultaneously clarifies the details of your booking. We use third- party payment service providers to make it easy for you to pay. Except in urgent situations, we commence the service only upon receiving the payment.

10. Communications from GOODMA

You agree on behalf of yourself and the Patient to receive communication in the form on SMS messages , email and calls on your mobile number and email id from both GOODMA and the Service Givers assigned to you. You agree to receive promotional messages in the form of newsletters, special offers and reminders and updates.

11. Termination

GOODMA may immediately terminate the Service at any time for any reason, through email/SMS communication on registered email address.

12. Refund Policy

In case of service is cancelled by GOODMA or Customer then refund will be processed in next seven working days.

13. Cancellation or Rescheduling

You may cancel or reschedule any appointment by informing customer care or through website or mobile app no later than 24 hours prior to the scheduled appointment. In case of request for rescheduling GOODMA does not guarantee that it will be able to provide the same Service Givers again and on the rescheduled time. GOODMA may cancel or reschedule any appointment without any prior notice.

14. Choice of Law

Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Mumbai.
